Obligations of the buyer
The Customer is strictly forbidden to provide false and/or fictitious data in the registration procedure necessary to activate towards him/her the process for the execution of this sales agreement and its further communications; the personal data and e-mail address must be exclusively the real personal data.
In the case of orders placed through www.cellagrande.it, the information contained in “Terms and Conditions of Sale” must be viewed and accepted by the Customer before the purchase order is sent.
Acceptance will be made by marking the space provided on the site. Failing this, the order cannot be executed.
Failure to deliver
Delivery requires the presence, at the address indicated on the order, of the customer or the customer’s designee.
If the customer or the person in charge is not present or insolvent, the customer will be charged (even on subsequent expenditure) for the cost of delivery, any stock and that of products that can no longer be sold to third parties.
Shipping methods for those placing an order directly to Società Agricola Tenuta Duca S.S. will be by express courier using the best National and International couriers: BRT, GLS, SDA and UPS.
In order to ensure the best value-for-money tracked express courier service, shipping is standard: within 24-48 working hours of the order being processed at our warehouses, the shipping service will email you a link to access the shipment tracking so that you can get real-time updates on delivery.
Although the dispatcher is given your phone number to contact you, we cannot guarantee that you will be contacted by phone since the dispatch service is external to our systems and therefore phone contact will only occur at the discretion of the driver who will physically handle the delivery.
We also specify that in the standard service there is an inability to indicate any preferred delivery time slots, but we can, however, upon specific request, use additional services such as priority, floor or by appointment delivery. Delivery times will be according to the country of delivery; in Italy they can be made within a week of receiving the order.
In case there are issues for which the delivery time is lengthened, the customer service of Società Agricola Tenuta Duca S.S. will inform the customer in due advance.
The shipping cost is €8.00 for purchases under €100 and free for amounts over €100 for destinations in the Italian peninsula and major islands . A one-time fee of €25 applies for Norway and Switzerland as well as €60 for China and the United States.
Methods of payment
Payment methods for those who place a direct order will be:
Advance bank transfer;
Società Agricola Tenuta Duca S.S reserves the right to take appropriate actions to collect the debt, including mandating specialized companies for recovery, charging interest on arrears, charging legal fees, varying payment terms. It is understood that the delivery of the products will be subject to the payment, by the Customer, of the relevant price in the manner made available by Società Agricola Tenuta Duca S.S.
Società Agricola Tenuta Duca S.S will handle any requested products that are not immediately available in stock (back-order) with top priority to minimize waiting time.
For greater transparency, the actual availability of goods or any waiting time is already indicated when browsing www.cellagrande.it.
Delivery will take place in one go: the Customer before sending order can decide whether to continue with the purchase (and thus wait for full availability of goods at our warehouse) or remove such unavailable products from the cart.
Returns management and right of withdrawal
Article 1 : Right of Withdrawal
Pursuant to D. Lgsl. 206/2005 and subsequent amendments, concerning the protection of consumers in contracts concluded at a distance, Società Agricola Tenuta Duca S.S informs the Customer of the following:
(a) The Customer may exercise the right of withdrawal within 14 days of receipt of the ordered goods for any reason, without explanation and without penalty;
b) may exercise the right of withdrawal only the Customer who purchases the goods for purposes unrelated to his or her business and work, providing for billing purposes his or her Tax Identification Number and not VAT number;
(c) the right of withdrawal must be exercised by the Client, within the period referred to in point (a), by notifying Società Agricola Tenuta Duca S.S by email to email@example.com

The right of withdrawal is excluded in the following cases, according to Art. 59 Legislative Decree 21/2014:
– Ordering custom-made or clearly customized Products;
– order of Products that are likely to deteriorate or expire quickly;
– order of sealed Products that are not suitable for return for hygienic or health protection-related reasons or that have been opened after delivery.
1.2 Contents of the declaration of withdrawal
The withdrawal statement communicated by the customer must necessarily contain:
(a) clear and precise reference to the order for which the withdrawal is to be exercised;
(b) the express statement of the Customer’s desire to withdraw in whole or in part from the purchase contract;
(c) the description and code of the products to which the intention to withdraw refers;
d) in the case of reimbursement by bank transfer, the bank details relating to the bank account where the Customer intends to receive the relevant reimbursements.
1.3 Notice of withdrawal

1.4 Client’s Obligations
The Customer undertakes to keep and guard with the diligence of a good family man the products for which he intends to exercise the right of withdrawal, keeping them intact in their original packaging together with all the accessories and documentation with which they are accompanied.
1.5 Return of goods
The Customer undertakes to return the products for which the right of withdrawal has been exercised no later than 15 days from the communication of his intention to withdraw. The products must be shipped to the Seller Company’s operational headquarters, namely at Società Agricola Tenuta Duca S.S.- Via Cascine di Ponente, 21 – 13886 Viverone (Biella) Italy. The return of products that are not intact, damaged or missing components and/or accessories, including documentation, will not be accepted by the Seller Company, which will return the goods to the Customer with additional transportation costs. In such circumstances, the Customer will not be able to exercise the right of withdrawal.
Società Agricola Tenuta Duca S.S. will, within 14 days of receipt of the goods at the warehouse located at Via Cascine di Ponente, 21 – 13886 Viverone (Biella) Italy, under the terms and conditions set out above, refund the Customer the value of the products for which the right of withdrawal has been exercised, including any shipping costs. Return shipping costs are fully borne by the customer.
The refund will be made using the same method of payment used by the Customer, unless the Customer has expressly requested a different method. In case of bank transfer or cash on delivery payment, it will be the Customer’s responsibility to provide the bank details on which to obtain the refund (account holder, name and address of the Bank and IBAN).
1.7 Damage and deterioration
Under no circumstances may the Customer exercise the right of withdrawal if the goods are damaged and/or deteriorated.
If the product you wish to return has already been consumed/partially consumed, or opened or otherwise no longer for sale, please contact the manufacturer itself as we cannot accept this type of return.
Article 2 : Return
Guarantee free refund or replacement of defective or mismatched products.
No claim can be considered after 14 days after receipt of the goods and if the material is not returned in the original packaging. Should these requirements fail, the goods will be returned to the sender freight collect. However, it is understood that the warranty on the products can only be that offered by the Manufacturers, not assuming Società Agricola Tenuta Duca S.S any additional responsibility. Pursuant to Presidential Decree no. 472 of 14/08/96, the returned material must necessarily be accompanied by transport document containing the number and date of the document for the disputed product. For anything not expressly provided for in these general conditions, the rules of the Civil Code shall apply. Agricultural Society Tenuta Duca S.S reserves the right to make any changes to the original business proposal without any commitment or prior notice.
Traceability of products sold
On all products handled by Agricultural Society Tenuta Duca S.S and especially those regulated by regulations, total traceability of the items sold is guaranteed.
Inputs and outputs of materials from the warehouse of Società Agricola Tenuta Duca S.S follow FEFO (First Expired First Out) logic so as to control and guarantee the expiration date and freshness of products.
The entire warehouse is fully air-conditioned to ensure appropriate storage conditions for the products handled. The temperature is controlled according to the terms of the law or as specified by the manufacturers. Careful attention is paid to the state of preservation of products both during storage and shipping.
The products will be packed and shipped with the utmost care and safety, using the “air cushion” system, respecting the environment and hygiene.
In this way the package travels safe and well protected and will not generate clutter created by Styrofoam or paper.
In addition, inflated pillows can be reused numerous times, and upon disposal, the pillows will occupy only 1% of their initial volume.
The Customer and / or the person appointed by the same to collect the goods will be required to check, at the time of delivery and in the presence of the carrier, the integrity of the packages delivered and their number, reporting in writing any discrepancies in the number and / or integrity of packages in the space reserved in the transport document (DDT) that duly signed will remain with the carrier. Having done so, the Customer must contact Società Agricola Tenuta Duca S.S to report any problems within 10 days of delivery.
The product images and information in the fact sheets correspond to the actual characteristics of the products as stated by the Manufacturer or Supplier to the Seller.
The information on product labels may vary for reasons beyond our control, so there may be discrepancies between the information on the site and the information on the products you purchase. The customer should always check the information on the product before consumption or use.
It is understood that any divergence between what is published on www.cellagrande.it and reality will not be attributable to Società Agricola Tenuta Duca S.S, which will not be responsible for the truth of the information provided by the Producer or Supplier.
Photographs presenting the products and data sheets will not be part of the contractual scope and can under no circumstances be considered the responsibility of Società Agricola Tenuta Duca S.S.
The technical data sheets and pictures of the products are made available by the Producers and Suppliers so Società Agricola Tenuta Duca S.S disclaims any responsibility regarding their content and the actual correspondence with the reality of what is described therein.
Products will not be provided on trial.
The Customer will be responsible for choosing the products ordered.

The Customer shall independently equip itself with equipment and programs suitable for connection to the Internet. Should the Client no longer be able to view part or all of www.cellagrande.it no charge or responsibility can be attributed to Società Agricola Tenuta Duca S.S. Società Agricola Tenuta Duca S.S does not guarantee that the site www.cellagrande.it will function without errors or interruptions. Uses of this Web site that could prevent its use by other Internet users, impair its functionality, and/or affect the information provided on or through it or the underlying software are prohibited. Società Agricola Tenuta Duca S.S will not be held liable for any damage, direct or indirect, arising in any way from access to this site and/or (the use of) information provided on or through the site. The parties will have the right to terminate the order contract with immediate effect in the event of non-fulfillment, even partial, of the obligations arising on the part of the other party by means of written notice to be sent to the same by registered letter A.R. Società Agricola Tenuta Duca S.S also reserves the right to refuse any other subsequent order from the defaulting Customer, also reserving the right to take legal action to protect its rights.
Società Agricola Tenuta Duca S.S will not be held liable to the Client for delays or non-performance of contractual obligations caused, directly or indirectly, by force majeure beyond its control, such as: natural phenomena of particular intensity, war events, strikes, unforeseen restrictions ordered by the authorities, etc. In such cases, the party concerned will notify Società Agricola Tenuta Duca S.S. promptly of the event. In any case of force majeure, it will be the right of the parties to cancel the order contract or request its execution within a term to be fixed.
LIMITATIONS OF LIABILITY
Società Agricola Tenuta Duca S.S. assumes no responsibility for disruptions attributable to force majeure that prevented, in whole or in part, the execution of the sales agreement within the agreed time frame
Società Agricola Tenuta Duca S.S. will not be liable to any party with respect to damages, losses and costs incurred as a result of the non-performance of the sales agreement for the causes mentioned above, or with respect to damages, losses and costs incurred as a result of the use or inability to use the products purchased, the Customer having the right only to any refund of the price paid, excluding any shipping costs.
Società Agricola Tenuta Duca S.S. cannot be held responsible for the loss or damage suffered by the Customer due to delays, slowdowns and interruptions of the e-commerce service, if such events do not depend on its own conduct or are caused by the malfunction of telecommunication services.
Società Agricola Tenuta Duca S.S. cannot be held responsible for delays in the execution of the purchase order or its non-execution, if such situations are caused by impediments beyond its control.

In these cases Società Agricola Tenuta Duca S.S., except for reasons of particular urgency, will notify customers by any means deemed appropriate and as soon as possible.
JURISDICTION AND APPLICABLE LAW
The contract of sale between Società Agricola Tenuta Duca S.S. and the Customer is concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, the territorial jurisdiction will be exclusively that of the Court of Turin.
ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
By placing an order in the various ways provided, the Customer declares that he/she has read all the information provided to him/her during the purchase procedure, and that he/she fully accepts the General and Payment Conditions. Therefore, in accordance with Articles 1341 and 1342 of the Civil Code, the Customer declares that he/she has carefully read the above General Conditions in all its points and, after careful rereading, expressly accepts all its points.
